The provisions of Polish Labour Code apply only to persons employed with employment agreements.<\/p><p>Employment based on civil law agreements and self-employment are generally more flexible and less expensive for the employers. However, the parties should always remember to create the agreement in accordance with specific rules for employment or civil law agreements.<\/p><p>By establishing an employment relationship, an employee undertakes to perform work of a specified type for the benefit of an employer and under his or her supervision, in a place and at the time specified by the employer. The employment contract cannot be replaced by the civil law contract where the performance of work conditions specified above apply. If a civil law contract provides rules characteristic of an employment contract, it can be deemed as an employment contract.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b14a521 elementor-widget elementor-widget-heading\" data-id=\"b14a521\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Types of employment agreement  <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-117e2e4 elementor-widget elementor-widget-text-editor\" data-id=\"117e2e4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>There are three types of employment agreements in Poland:<\/p><ul><li>employment agreement for trial period (for the maximum period of 3 months)<\/li><li>employment agreement for definite period<\/li><li>employment agreement for indefinite period<\/li><\/ul><p>\u00a0<\/p><p>All foreigners, EU and non-EU residents, can be employed based on the same types of agreements as Polish citizens.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-69c5a7c elementor-widget elementor-widget-heading\" data-id=\"69c5a7c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Working time <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4b1d82a elementor-widget elementor-widget-text-editor\" data-id=\"4b1d82a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tAccording to Polish Labour Code, the working time should not exceed eight hours per day and 40 hours per five-day-long working week on average and a weekly working time, including the overtime hours, should not exceed 48 hours on average. \t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-633e99c elementor-widget elementor-widget-heading\" data-id=\"633e99c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Minimum wage <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-aef13b7 elementor-widget elementor-widget-text-editor\" data-id=\"aef13b7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tThe remuneration in Poland cannot be lower than minimum wage, which is determined by the Council of Ministers. In 2021 the minimum wage amounts to PLN 2,800 (approx. EUR 620) gross per month. \t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6ac65db elementor-widget elementor-widget-heading\" data-id=\"6ac65db\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Civil law contracts <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2338d3f elementor-widget elementor-widget-text-editor\" data-id=\"2338d3f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>There are two main types of\u202fcivil\u202flaw\u202fcontracts in Poland \u2013 the\u202fcontract\u202fto perform specified work (umowa o dzie\u0142o) and the\u202fcontract\u202fof mandate (umowa zlecenie).<\/p><p>The contract to perform specified work is most common for seasonal work and within IP sector (creative, new tech). Within this contract parties often transfer intellectual property rights. The crucial characteristic of a contract to perform specified task is the fact that it defines its termination date by completing the specified work.<\/p><p>The purpose of a contract of mandate is the performance of specified activities by the party who accepts an order (an agent) for the benefit of the party who orders an order (a principal). This contract is usually concluded for an indefinite time and can be in any time terminated.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a9e4af7 elementor-widget elementor-widget-heading\" data-id=\"a9e4af7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Self-employment <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8b01197 elementor-widget elementor-widget-text-editor\" data-id=\"8b01197\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Self-employment is a specific relationship between an employee and an employer. It assumes that entrepreneurs are equal partners. An employee is not subordinate and can organize his work at his own discretion.
